TERMS OF SALE

These terms of sale (hereinafter the "Terms") govern the contractual relationship between [business name], [legal form], whose registered office is located at [registered address], registered under company number [company number] (hereinafter the "Seller"), and any person making a purchase (hereinafter the "Customer").

1. PURPOSE

The purpose of these Terms is to define the conditions under which the Seller offers products for sale to the Customer. Any order implies full and unreserved acceptance of these Terms.

2. PRICES

Prices are stated in euros, all taxes included (incl. VAT). The Seller reserves the right to change its prices at any time, it being understood that the applicable price is the one in force on the day of the order.

3. ORDERS

The Customer places an order through the channel made available by the Seller. An order is only finally confirmed once the Seller has confirmed it and, where applicable, full payment has been made.

4. PAYMENT

Purchases are paid for by the following means: [payment methods, e.g. card, bank transfer]. Payment is due immediately upon order, unless otherwise agreed between the parties.

5. DELIVERY

Products and services are supplied within the following time frame: [delivery time]. This time frame begins once the order is confirmed. In the event of a delay, the Customer is informed as soon as possible.

6. RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the French Consumer Code, a Customer acting as a consumer has 14 days from receipt of the products or from the conclusion of the service contract to exercise their right of withdrawal, without having to give reasons or pay any penalty. Unless otherwise agreed, return costs remain the responsibility of the Customer.

7. WARRANTIES

The Customer benefits from the legal warranty of conformity (Articles L217-3 and following of the French Consumer Code) as well as the warranty against hidden defects (Articles 1641 and following of the French Civil Code). These warranties apply regardless of any commercial warranty that may be granted.

8. PERSONAL DATA

The personal data collected is needed to process orders. In accordance with the General Data Protection Regulation (GDPR) and applicable data protection law, the Customer has the right to access, correct, object to and delete their data, which they can exercise by writing to [email address].

9. DISPUTES AND MEDIATION

In the event of a dispute, the Customer should send a complaint to the Seller in order to find an amicable solution. Failing an agreement, a Customer acting as a consumer may use the services of a consumer ombudsman free of charge, in accordance with Articles L611-1 and following of the French Consumer Code.

10. GOVERNING LAW

These Terms are governed by French law. Failing an amicable resolution, any dispute falls under the jurisdiction of the French courts.

Why have Terms of Sale?

Terms of sale form the contract that frames the relationship between a seller and their customers: they set out the rights and obligations of each party. They are mandatory for any online sale to consumers (B2C) and must be provided before the order is confirmed.

When are they mandatory?

As soon as you sell products or services online to individuals, your Terms of Sale must be accessible and accepted by the customer before any purchase. Between businesses (B2B), they are provided on request.
